Cardly for iPhone - Terms and Conditions
Last updated: October 1, 2026
Please read these Terms and Conditions ("Terms") carefully before using the Cardly app for iPhone ("App") published by Samantha Toha, trading as Woohoo Software ("we", "us", or "our"). The Android app has its own Terms.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, do not use the App. Apple's standard Licensed Application End User License Agreement also applies; where the two differ, these Terms apply to the extent Apple's agreement allows.
1. Use of the App
We grant you a non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes on Apple devices that you own or control, as permitted by the App Store terms. You agree not to:
- Copy, modify, or distribute the App or its content
- Reverse engineer, decompile, or disassemble the App
- Use the App for any unlawful purpose, including storing cards that are not yours to use
- Attempt to gain unauthorised access to any part of the App
2. Data Ownership and Privacy
Your card data (card names, barcodes, card numbers, PINs, gift-card balances, notes and card pictures) is private and remains yours — only you can see it. We do not collect, store, or have access to your data. No account is required to use the App, and we do not display third-party advertisements. If you use iCloud sync, your cards are stored in your own iCloud account under your Apple Account — we have no access to your iCloud account or to that copy.
You are responsible for keeping your own copies of your data; the App's export feature exists for that. We are not liable for any data loss. For more information on how we handle data, please see our Privacy Policy.
3. Your Cards and Balances
Cardly stores copies of your cards for your convenience. It is not a payment method and has no connection to the shops or companies that issue your cards.
- Your cards, and the rewards and money on them, are governed by the terms of the company that issued them
- Gift-card balances in the App are the amounts you enter; they are not checked with the issuer, and the issuer's records are the ones that count
- A shop may decline to scan a barcode from a phone screen or ask to see the physical card. We are not responsible if a card shown in the App is not accepted
- Store names, logos and card designs belong to their owners; the App is not affiliated with or endorsed by them
4. Premium and Payments
The App is free to use. Cardly Premium is an optional one-time in-app purchase that unlocks additional features ("Premium"). It is not a subscription.
Purchase
- Premium is a single payment, charged to your Apple Account at confirmation of purchase
- There is no recurring charge, nothing to renew, and nothing to cancel
- Premium is tied to the Apple Account that bought it and can be restored on other devices signed in with that Apple Account using Restore
- The price is shown in the App at the time of purchase, in your own currency
Refunds
Purchases are made through Apple's App Store. Refund requests are handled by Apple in accordance with its own policies; we cannot issue refunds ourselves.
5. Premium Features
Premium unlocks the following features:
- Four more wallet views: List, Compact grid, Stack and Full cards
- Unlimited gift cards, including linking and balance tracking
- Up to 10 pictures per card, from the camera or your photo library
- Notes on your cards
- Reminders before gift cards expire
- Import and export of your cards
- More Home Screen widgets, and Control Center controls
- Face ID or passcode app lock
- Removal of the built-in "More Apps" tiles
The free version places no limit on how many cards you store, and includes one gift card (which may be linked to rewards cards and have its balance tracked), two pictures per card from the camera, and the Cardly Card widgets. We may add new premium features over time. Existing features included in Premium will not be removed.
6. Intellectual Property
All trademarks, copyright, database rights, and other intellectual property rights in the App belong to Woohoo Software, except the third-party components acknowledged in the App. You may not copy, modify, or create derivative works from any part of the App.
7. Disclaimers and Limitation of Liability
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
To the maximum extent permitted by law, Woohoo Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of card balances or rewards, loss of profits, or business interruption, arising from your use of the App.
You have sole responsibility for adequate backup of your data, and for keeping your cards, PINs and any export files secure. We are not responsible for any data loss resulting from device failure, app deletion, sync, a forgotten export password, or any other cause.
Without limiting the foregoing, our aggregate liability to you shall not exceed the total amounts paid by you to us in the twelve (12) months preceding any claim. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be excluded.
8. Indemnification
You agree to indemnify and hold harmless Woohoo Software from any claims, damages, losses, or expenses arising out of your use of the App or your breach of these Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
